Bookings

When you book an activity, you “reserve” a spot in the class of your choice. The teacher will keep this spot open for you. You can cancel your booking up to 24 hours in advance; see our cancellation policy for the exact terms and conditions. The payment for the activity should be made to the teacher or the studio before or after the class, as they request.
Find the activity that you like at the time that suits you. Select the price option suitable for you and click on the “book” button.
Prices are set by the teacher or studio, which means they may differ. Teachers and studios may also discount some activities as a promotion to attract more students.
You can cancel your reservation by logging into your account: go to the “My Bookings” tab, look for the class, retreat, workshop or teacher training that you want to cancel and click on the delete button. You can cancel an activity up to 24 hours in advance. See cancellation policy for all terms and conditions.
Check with the teacher or studio if you can still join the class. If you cannot, this will be considered a “no-show” and your account can be suspended after 3 times. See cancellation policy for the exact terms and conditions.

Students

It depends on the teacher or studio and what is provided on site. Look at the “Practical Information tab” on the teacher or studio page to see what they provide.
It is always best to wear light, comfortable clothing that allows for easy movement.
Beginner's level: can be attended by any person, but is specifically meant for people starting out in yoga, who have little or no experience. A good beginner’s class helps you understand the yoga concept, the basic poses and the importance of breathing.
Intermediate level: is specifically designed for students who have a good understanding of the basic yoga postures. The intermediate students understand the relationship between breath and movement.
Advanced level: is for experienced yoga practitioners who have an excellent understanding of yoga postures and the connection between breath and movement. They are willing to try more advanced yoga postures.
Professional level: is specifically designed for yoga teachers who want to improve their teaching. This level requires a broad understanding of and control over advanced postures.
When all levels are included in a class it means that the class is suitable for beginner, intermediate or advanced students. It is designed so that students can control the intensity/level of the poses; the teacher offers multiple options.
The “account balance” tab allows you to see if you have purchased a plan or subscription with a teacher or studio, how much credits are left, how much you have paid in total and the expiration date. For example, you have bought a 10 -class card from your favorite teacher. You book the class and after the class your teacher will indicate in their profile that you have attended. One credit will be taken off your subscription and you will see 9 credits left, which have to be used before the specified end date. The teacher or studio is responsible for keeping the system up to date with the correct information on number of credits, total cost and expiration date. If any information is incorrect contact them directly.
The account balance also shows you if you book individual classes regularly without a plan or a subscription and the price you pay to the teacher or studio.

Professionals

On the homepage go to the tab “Professionals” in the upper right-hand corner. Click on ‘Get started’ and fill in the form with information on the first class that you want to list. You will then be asked to create a profile and to confirm your email. This will give you access to your own profile, where you can then add more classes under the tab “My Events” by clicking on “Add new event” on the left side or directly on the day in the calendar.
Be as clear as possible so students know what to expect, but do not write a book! Follow the steps in each column and review your listing before publishing it. Put yourself in the shoes of the student: what would you like to know?
A class is taught on a regular basis and is usually repetitive. A workshop is about a specific topic, for a variable period of time and is usually not repetitive.
Yes, please do. When adding your event, simply choose workshop/retreat or teacher training as event type and complete in the boxes with the right information. For a Yoga Teacher Training, a separate page will be automatically created to display all the information requested. This will not show up on your “class” page.
We ask for a minimum of 3 spots per class to be available for students who book through Where Is My Mat, but you can always allocate more or even your whole class.
If you have a maximum capacity of 12 students for a class, at least 3 spots (or more) are reserved for Where Is My Mat.
If these spots are not booked through Where Is My Mat, they are still available for walk-in students. If a spot is booked through Where Is My Mat, it is reserved for the student and the teacher or studio should keep track of the maximum number of students.
It’s really a win-win situation, since you can market your class to new students and if the spots are not taken by Where Is My Mat, you can still use them for walk-in students.
Yes, when adding a new event you have the option to choose “add a teacher”. This information will be displayed on the public event page.
If you are the owner or manager of the location, you will have the administrative rights to this listing for this location and will be able to make changes to it in the future. This is to avoid multiple people accessing the same location and giving conflicting information. If you are not the owner or manager of the location or the manager then select “no” and if possible add that person.
You can indicate all practical information that a student should know about the event and location. For instance, what to bring with them or what to wear. This information will be visible to the public on the location page.
In “Private Information” you can add if a code is needed to enter the building. Private information will be sent to students by email when they book the class.
When adding a new event, you can add a new price list, which you can reuse each time you add a new class. For instance, if you use the same prices throughout 2016 you just have to define one price list, called ‘2016 price list’ and fill in all relevant prices.
For each of the regular prices you can add a discounted price. For example, if a regular class is €20, you can also add a promotional price of €15. The promotional prices will only be displayed if you select “Enable discount prices” in the “add an event” page.
Drop-in class: this is the price for a regular walk-in class, without a subscription. .
Class card: this the price for a card for which the student can go a defined number of classes over a specified period of time. For example ; a 10-class card which has to be used in 6 months.
Unlimited plan: this is the price for a plan for which the student pays a specific amount to be able to go unlimited times to the class and/or studio for a specified period of time. For example; a student pays €50 to be able to go unlimited times to a class and or/studio during the month of April 2016.
New Member offer: this is the price for a student who comes in for the first time to the class and/or studio. A student who booked a new member price via Where Is My Mat with a specific teacher and/or studio cannot book with that offer again after. It is only usable once for each teacher or studio. A New member offer helps attract new students to your class.
Accommodations: this is the price if you provide accommodations, when organizing a workshop, retreat or teacher training for example. The price of the accommodation will show seperately of the event.
Extra activities: this is the price for any additional activity that do do not fit into any of the aforementioned prices.

Your different pricing lists are saved in the tab “Pricing” and can be changed at any time.

If you login to your profile and go the “My Account”, you see an option down on the page to delete your account.
In the tab ‘Student registration’ in My Events you can review each class to see who participated in your class. This is manageable in the tab ‘Student Check in’.
After each class, workshop, retreat or teacher training you can go to the tab “Student Check in” and you either register the students who attended your class or you “check in” the students who booked your class through Where Is My Mat. Check in and registration is needed to keep track of the credits purchased from you.
When you go to the “My Activity” tab and then click on “My Students”, you will be able to see the students that attend your classes, whether they booked through Where Is My Mat or registered directly with you. Here you will also be able to track the credits a student has purchased from you.
When you go the “My Activity” tab and click on “Event Registrations” you will see the classes you have booked to participate in yourself.

Privacy Policy for Where Is My Mat services

Where Is My Mat (“We”, “Us” or “Our”), operating through www.whereismymat.com (the “Website”), is a platform designed to bring together yoga students, teachers and studios to create a global community, whether on the website or via our mobile applications.

We take your privacy very seriously. Please read our privacy policy carefully to get a clear understanding of our practices with respect to how we collect, use, protect or otherwise handle your Personally Identifiable Information (PII) in accordance with applicable law. Personal information is information that is personally identifiable, including your name, email address, phone number, mailing address, etc.

1. When and how we collect information

Where Is My Mat collects personal information when you visit our website, when you use our search engine to find a yoga class, retreat, workshop or teacher training and when you create an account or login to your account.

1.1 Information that you give us
When you create an account on Where Is My Mat we ask you to provide personal information including your gender, name, email address, phone number and date of birth. This information is stored and linked to your personal account on Where Is My Mat. By linking your account to a third party (e.g. Facebook) we will obtain personal information that you have provided to the third party and, by doing so, you expressly authorize such third parties to share your personal information with us.

1.2 Log Data
We collect information that your browser sends whenever you visit our website. This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our website that you visit, the time and date of your visit, the time spent on those pages and other statistics. We use this information for (i) analytical purposes, to understand what works well on the website and to improve the customer experience; (ii) to display relevant content to consumers visiting the website; and (iii) to display by default the chosen language of the browser.

In addition, we may use third party services such as Google Analytics to collect, monitor and analyze this data.

1.3 Cookies
Where Is My Mat sets and accesses cookies on your computer. A cookie is a small text file which is used to: (i) store information about your preferences, location and other details; (ii) protect your data from unauthorized access: (iii) maintain certain websites’ functionality; (iv) show personalized ads to you and make advertising more effective via re-marketing. Cookies are stored on your hard disk and you may disable or delete cookies from within your Internet browser application by accessing the security or privacy settings. There are two type of cookies used across the internet: (i) First party cookies, which are issued by the website visited and only the website which issues the cookies can read them; (ii) Third party cookies, issued by website(s) other than the website being visited. However, Where Is My Mat requires you to have cookies enabled to access certain portions of the site. Where Is My Mat makes use of first and third party cookies.

We use first party cookies to:
  • Understand and save your preferences for future visits to streamline your experience.
  • Compile aggregate data about site traffic and site interactions in order to continuously improve our site. We may also use trusted third party services that track this information on our behalf.
  • If you choose to save your name and password, Where Is My Mat will save this information in a cookie so that you will not be required to sign in each time you visit the site.

We use third party cookies to:
  • Show advertisements on some of our pages;
  • Keep track of advertisements.

Where Is My Mat may allow other companies to show ads on some of our pages to set and access their cookies on your computer by making use of third party cookies. Where Is My Mat provides links to third party websites, for example after a search, and may provide referrals to certain third parties' products or services. The inclusion of a link to a website does not represent or imply Where Is My Mat ’s endorsement of the website. Such third party websites may have separate privacy and data collection practices, independent of Where Is My Mat. 2. What personal information do we collect?

Where Is My Mat automatically receives and records information in our server logs from your browser, including your IP address, browser type, the pages you request, your name, email, phone number and country of residence. Where Is My Mat does not require that you enter any personal information to search on www.whereismymat.com, nor when being transferred to third-party websites (i.e. a teacher’s or studio’s website).

We do however require you to create an account or login when you want to book a class, workshop, retreat or teacher training. When creating an account, we require you to provide the following information: first and last name, email address, birth date, address, ZIP, state or region, country of residence, gender and phone number.

We also track your preferences for specific yoga classes, types etc. so that when you book on Where Is My Mat, the site can offer classes that might interest you, show relevant content and promote certain offers to you, which are in line with the interests expressed in previous visits.

3. How do we use your Information?

Where Is My Mat uses your personal information for the following purposes:
  • to verify your authorization to access certain features of the site:
  • to fulfill your requests for products or services;
  • to personalize and customize the content of the website;
  • to contact you, e.g. if you have subscribed to a newsletter:
  • to improve our services;
  • to provide reporting;
  • to administer a contest, promotion, survey or other site feature.

3.1 Personal information shared with teachers and studios
A teacher or studio will be provided with your full name at the time you book a class, workshop, retreat or teacher training. When you purchase a class card or plan directly from the teacher or the yoga studio, the teacher and studio can input this information in the system of Where Is My Mat for tracking purposes for the teacher and studio. This includes your first name, last name, email address, phone number, class credit purchased, expiry date of the class credit, purchase date, price paid and to whom. This information is shared with Where Is My Mat.

If you are already a registered student on Where Is My Mat, the teacher and studio can search for you and link the purchased plan to your profile. You will be able to find your purchased plan within your profile in the tab “My bookings” and after “My account balance”. If you are not a registered student on Where Is My Mat, the teacher and/or studio can register you as a student. You will then receive an email from Where Is My Mat to register.

3.2 Marketing purposes
For marketing purposes, we use your personal information like name, email address, preferences and past booking information to send specific offers, promotions and information. This can be done by our newsletter, targeted banner, retargeting around the internet and other services. If you do not want to receive these offers you can email us at contact@whereismymat.com or if you receive a marketing newsletter you can also click on the unsubscribe link in the footer of the email. Please note that booking confirmation and similar emails are not considered marketing emails.

3.3 Information Sharing and Disclosure
Where Is My Mat does not rent, sell, or share personal information about you with other people or companies except: (i) to provide products or services you've requested including, without limitation, products and services from third parties; (ii) when we have your permission; or (iii) under the following circumstances:
  • In response to subpoenas, court orders, or legal procedures, or to establish or exercise our legal rights or defend against legal claims; when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Where Is My Mat 's Terms of Service, or as otherwise required by law.
  • We may transfer information about you if Where Is My Mat is acquired by or merged with another company. In this event, Where Is My Mat will notify you by sending a notice to the email address specified in your Where Is My Mat account before information about you becomes subject to a different privacy policy.

This does not include website hosting partners and other parties who assist us in operating our website so long as our agreements with such third parties provide for such parties’ commitment to give the same level of protection as we do when handling your personal data and restrict their use of your personal data for the purpose of our agreements only.

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

3.4 Confidentiality and Security within Where Is My Mat
We limit access to personal information about you to our employees who we believe have a legitimate need to come into contact with that information to provide products or services to you or in order to do their jobs. Where Is My Mat employs procedural and technical measures reasonably designed to protect your personal information from loss, misuse, unauthorized access or disclosure. Although we use our best efforts to store the information collected in a secure operating environment that is not accessible to the public, we cannot guarantee complete security.

4. Accessing, Objecting to and Correcting your Personal Information

This Privacy Policy is effective as of 25 April 2016 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. In accordance of the French law, No. 78-17 of 6 January 1978 on Information Technology, Files and Freedoms, you have a right to access and correct personal data about treatment of your personal identifying data. You have the right to access, to object or to correct certain information via the Registration page.

Upon your request, we will deactivate your account, and remove your personal information from active service. After receiving this request, we will retain in our files and databases personal information to prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, to enforce our Terms of Use and comply with legal requirements as permitted by law, for up to 12 months after the date of receipt of the deactivation request. Therefore, you should not expect that all of your personal information will be completely and immediately removed from our databases in response to your request .

If at any time you would like to unsubscribe from receiving future marketing emails, you can email us at contact@whereismymat.com and we will promptly remove you from all correspondence, except legal correspondence.

Where Is My Mat reserves the right to update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the email address specified in your Where Is My Mat account or by placing a notice on our site. If you do not agree with the changes to the Privacy Policy you may deactivate your account by logging into your account, go to “My account” and click on “cancel my account”.

This Privacy Policy is governed by French law. You submit to the exclusive jurisdiction of the courts of Paris in respect of any dispute or matter arising out of or connected with this Privacy Policy. However, as a consumer, nothing in this Agreement shall deprive you of the protection granted by the provisions of your local rights in correspondence of public policy and laws (in particular those defining consumer rights).

1.e Accepting the Terms
In order to use our Service, you must first agree to these Terms. You may not use the Service if you do not accept the Terms. You implicitly accept the Terms by simply using the Service. You understand and agree that Where Is My Mat will treat your use of the Service as acceptance of the Terms from that point onwards.

1.f Changes to the Terms
Where Is My Mat reserves the right to modify part of or all Terms at any time. This may entail anything from minor changes to major changes, such as legal regulatory changes. Modified Terms will be posted on the T&C page on Where Is My Mat. In case of additional terms and conditions added or significant changes made to the existing Terms, which include changes which impact your obligations towards our services, we will send you an email with the notification that the Terms and Conditions have changed. Your continued use of the Service after the date the modified Terms are posted will constitute your acceptance of the modified Terms. If you do not accept the new Terms you must unsubscribe from our Services by sending us an email to contact@whereismymat.com.

1.f Breach of Terms
In case of your non-compliance with these Terms, Where Is My Mat reserves the right to suspend and / or deny access to the Services without notifying you.

2. Scope of our Service

Where Is My Mat provides an online platform through which all types of yoga classes can be offered by yoga professionals and through which visitors to the website can search for these classes and make reservations.
Yoga professionals are yoga teachers, studios, gyms and any institution that can give a yoga class. Yoga non-professionals or yogis are any visitor to the website who wants to participate in a class. Classes can be a recurring class, a workshop, a retreat, a yoga teacher training course or any other activity in relation to yoga offered on our Site.

2.a Service for Non-professionals or Yogis
Where Is My Mat offers you a free service to access available activities, made available by Yoga Professionals, to facilitate your online search, making reservations, or subscribing to plans or packages. These reservation or subscriptions are made in real time via the Site, using any one of multiple devices.

You can search for and view information on classes without being registered on the Site. However, when you want to book a class you must create an account on Where Is My Mat

By making a reservation through Whereismymat.com, you enter into a direct (legally binding) contractual relationship with the class provider. From the point at which you make a reservation, we act solely as an intermediary between you and the provider, transmitting the details of your reservation to the relevant Yoga Professional and sending you a confirmation email for and on behalf of the Yoga Professional.

2.b Service for Yoga Professionals
Where Is My Mat offers studios, yoga teachers, retreat organizers and any other institute or person that organizes a yoga class, via the Site, a tool for managing bookings and activities that you add in your account and publish on our website. Information on your classes will be available to all visitors to the website and subscribers in order to attract new yogis to your classes. Our Service allows you to communicate the characteristics of your business and the subscriptions or packages that you offer.

You are fully responsible for updating all your listings, availability, rates and other information which is displayed on our Site.

2.c Information accuracy of Services
Please note that the use of the Site, application and services is intended to facilitate the interaction between Yoga Non-Professionals or Yogis and Yoga Professionals. Yoga Professionals can add their classes, workshops, teacher trainings, retreats or other activities and once published they can be booked by the Yogis. Where Is My Mat cannot control the content of the published classes, neither the legal conditions nor the prices of these classes. Although we will use reasonable skill and care in performing our services we cannot check everything, and we cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors, inaccurate, misleading or untrue information or non-delivery of information.

3. Account Creation

You can freely browse the Site, but to access certain features, to book an activity or to create a listing you must create an account and become a member. You can register to make use of the Service directly on the Site.

3.a Mandatory information
When you create an account you must provide all information marked as mandatory. An incomplete registration will be considered as a non-valid account. Registration and creating an account will give you automatic access to a personal profile (hereinafter “Profile”) where you can manage the use of our Service. You guarantee that all information provided upon account creation is accurate, timely and sincere and is by no means misleading. You are responsible for keeping all information in your Profile up to date. You understand and agree that the information provided upon account creation is proof of your identity and are used to personally identify you when making use of our Service or visiting our Site.

3.b Accessibility and responsibility
You can access your personal account or Profile at any time by visiting our Site and identifying yourself using your username and password. You are solely responsible for maintaining the confidentiality of your username and password. You agree not to permit any third party to use your Profile on your behalf unless you gave explicit consent to this third party and you bear the full responsibility. We understand that for Yoga Professionals there is an option of sharing the access of one account or Profile with different persons; this can be for a yoga studio account for instance. In this case the person that created the Profile gives explicit consent to the other parties to use the Profile and bears full responsibility for the use of the Profile for her or himself and the other parties. If you notice your account being used without your knowledge or suspect misuse of your account by anyone other than yourself or parties you have consented to use your Profile, please contact Where Is My Mat immediately at the contact details provided in section 2 of these Terms. You agree that Where Is My Mat can take appropriate measures in such case to ensure the safety of your Profile and our Service.

3.c Communication
You accept that we will use your email address and mobile phone number for the transmission of information to you on the Service provided by Where Is My Mat. You are automatically opted in for marketing, product and Services communication, but can actively opt out for marketing communication in your Profile. You are not allowed to opt out for product, Services and legal communication.

To prove the content and terms and conditions of our email communications and information exchanges to you, you can print your received emails on paper.

The following section 4 is intended for Yoga Professionals only

4. Class listing

By being a member of our Site as a Yoga Professional you are able to create a listing of your class(es), workshop, retreat, yoga teacher training or any other activity associated to yoga. To create the listing, you are requested to provide various information, including the procedures for the event, including location, features, availability, pricing and financial rules and conditions that apply. All listings and Classes are obliged to have a valid physical address. Your listing will be featured on our Site once you agree to publish it. Other members of the Site, including non-professionals, Yogis or other Yoga Professionals, are able to see information on and book your Class through the Site once it is published. You understand and agree that all information associated with your event, once published, is offered to members of the Site and that in no way whatsoever you are able to ask a person who made a booking, to change any of these procedures. If you have stated, for instance, that the price is 10 euros, and a person has booked your class, you are not allowed to ask the person to pay 11 euros. You acknowledge and agree that you are solely responsible for all content of your listed Classes. Where Is My Mat reserves the right to, at any time, without notice, remove, disable, access or change your listing for any reason whatsoever, including listings that we think, in our sole discretion, can be considered as questionable or harmful for our Site.

4.a Creating an activity for a Yoga Professional
As a Yoga Professional, you can add your class(es) with the intent to publish on the Site to make them available for booking. You are solely responsible for managing the timeliness, availability and reliability of information provided for your listed Classes. The cancellation policy is set by Where Is My Mat and can be consulted in paragraph 6 of these Terms and Conditions.

If you use other booking methods (online, by phone, direct or through intermediaries), you agree and acknowledge that you and you alone are responsible for updating in real-time the information provided and the availability of your Class(es) displayed on our Site. Once a booking is made via our Site in a time slot identified as “available” on the Site, you alone bear all consequences of any inaccuracy of information or mistaken reservations that may arise.

4.b Commitment to your customers
You acknowledge, agree and commit that you will offer (to customers acquired via the Site) the same rates, discounts, subscriptions, sales offers, promotions and more generally, the same commercial terms and conditions and use of services as you offer to your own customers.

4.c Other commitments for Yoga Professionals
Any claims by Yoga Non-Professionals related to services provided by the Yoga Professional is forwarded directly to the Yoga Professional involved. You agree to provide Where Is My Mat as soon as possible, and within eight (8) days of the transfer request, a detailed response, or if appropriate a proposal for compensation to the person in question.

Furthermore, you agree to confirm participation of the Yoga Non-Professional in course (es), class (es), workshop (s), retreat (s), yoga teacher training or any other activity added by you to the Site, upon his/her arrival at the class or within forty-eight (48) hours after the start of the class.

4.d Limitations of liability
In accepting the reservation to your Class, you, the Yoga Professional, engages in a direct contractual relationship with the Yoga Non-Professional who booked your Class. As such, we, Where Is My Mat, acts only as an intermediary between you and the Yoga Non-Professional, by providing the details of the reservation and sending a confirmation message to the Yoga Non-Professional on behalf of you.

Where Is My Mat therefore disclaims any liability for breach of contract by any user of the Site (Yoga Professional or Yoga Non-Professional), or for any damage that may occur during the Class and/or by use of equipment at disposal, either physical or to the surroundings.

You are solely responsible for the activities practiced in your classes. You must enforce mandatory regulations such as safety rules, hygiene, discipline and respect for other users, to allow the best possible conditions for the class, particularly in terms of safety. You have the sole responsibility and authority to impose these set rules on Yoga Non-Professionals or any participants in your classes and to penalize them for violation of the regulations.

5. Terms and Cancellation policy

The Yoga Non-Professional can, via the Site, make a reservation with a Yoga Professional offering classes on Where Is My Mat. It is possible to see real-time information on the availability of the classes as provided by the Yoga Professionals.

5.a Selecting and booking
You, as a Yoga Non-Professional, are responsible for checking all information provided before proceeding with any booking on the Site. Before making a reservation, you are responsible for checking:
  • the quality, extent and level of services provided for the Class by the Yoga Professional;
  • more generally, if the activities provided by Yoga Professional meet your needs.

You are solely responsible for any booking you make. Where Is My Mat disclaims any liability concerning errors made by Yoga Professionals in the booking, such as errors in the date, place or booking schedule etc.

5.b Payment
The price of the Class you book is paid directly by Yoga Non-Professionals to the Yoga Professionals upon arrival in the class, and by providing your booking reference number.

5.c Cancellation Terms
Once you have booked a Class, the Yoga Professional has the right to modify the class, but acknowledges that the student has booked a class according to specific conditions and will have the right to bring these conditions to the attention of the Yoga Professional. Cancellation of an activity or listing has to be in accordance to the cancellation policy of Where Is My Mat as described in paragraph 6 of these Terms and Conditions.

6. Cancellation policy


6.a Cancellation policy for Yoga non-professionals
When you book a class, workshop, retreat, teacher training or any activity or event on Where Is My Mat, you have the right to cancel this booking up to 24 hours in advance. If you cancel the booking made less than 24 hours in advance you are subject to the cancellation policy of the Yoga Professional. This can mean that you are still liable to pay for the class you have booked in some cases. If you cancel 3 booked classes less than 24 hours in advance per month, your account may be suspended by us.

6.b Cancellation policy for Yoga Professionals
A Yoga Professional has the right to modify, change or cancel his class, but can only cancel his class more than 48 hours in advance, so that Where Is My Mat has the needed time to inform all students who have booked the class in a timely manner. If the Yoga Professional cancels his class less than 48 hours in advance it is the sole responsibility of the Yoga Professional to be able to offer another class under the same conditions to the students who had booked the cancelled class. If a Yoga Professional cancels more than 3 times an activity or class, less than 48 hours in advance, per month, his account is subject to be suspended.

7. User obligations

Both Yoga Professionals and Yoga Non-Professionals, hereinafter “the User(s)” or “You”, agree without prejudice to other obligations hereunder, to respect the following obligations:
  • You agree, in your use of the Service, to respect the laws and regulations to which you are subject and to not infringe the rights of others or the public order.


  • In this case the Yoga Professional is solely responsible for the proper fulfillment of all formalities, including administrative, fiscal and social regulations, as well as all due payments, fees or taxes of any kind due, as appropriate, in connection with his/her use of the Service. In no case whatsoever is Where Is My Mat responsible for these types of formalities.
  • You agree and acknowledge the characteristics and constraints of the Site, especially technically and that you are solely responsible for the use of the Service.
  • You are informed and agree that the implementation of the Service requires a connection to the internet and that the quality of the Service depends directly on the connection for which you alone are responsible.
  • You are solely responsible for establishing relations with other Users and the information you communicate to them as part of the Service. We recommend that you always act with caution and discernment in these relations and communications. You further agree and undertake that, in your exchanges with other Users, you will comply with the standard rules of politeness and courtesy.
  • You agree not to assign, or transfer any of your rights or obligations to any third party in any manner whatsoever.
  • You agree to provide Where Is My Mat all necessary information for the proper performance of the Service. More generally, you agree to cooperate actively with Where Is My Mat for the performance hereof.
  • You are solely responsible for the content of any kind (editorial, graphic, audiovisual or other, including the name and/or image) that you select for your event, hereinafter referred to as “Content”. You agree and guarantee that you have all the rights and permissions required to use the Content and that it is lawful, does not undermine public order, morality or rights of third parties and does not violate any statutory or regulatory provisions. More generally, you understand and agree that the Content you use will not entail any civil or criminal liability for Where is My Mat.
  • You understand and agree to not use and/or publish:
      (i) Pornographic, obscene, indecent, offensive or unsuitable for a family audience, defamatory, abusive, violent, racist, xenophobic or revisionist Content.
      (ii) Infringing Content.
      (iii) Untruthful, misleading or proposing or promoting illegal activity or fraudulent Content.
      (iv) Harmful Content for computer systems of third parties (such as viruses, worms, Trojans, etc.).
      (v) And more generally, Content that may adversely affect the rights of others or harm others in any manner and in any form whatsoever.
  • You must take the necessary measures to safeguard your own personal information as considered necessary.

8. User responsibilities

You safeguard Where Is My Mat against all demands, actions and/or claims that we could suffer due to breach of your obligations or warranties under these Terms. You will indemnify Where Is My Mat from any harm we would suffer and pay all fees, charges and/or convictions that you may incur because of this.

9. Prohibited activities and behaviors

It is strictly forbidden to use the Service for:
  • Pursuing illegal or fraudulent activity or to violate the rights or safety of others.
  • Breaching public order or any violation of laws and regulations.
  • Intruding into the computer system of a third party or any activity likely to harm, control, interfere or intercept all or part of the computer system of a third party by violating its integrity or security.
  • Sending unsolicited and / or commercial solicitation emails.
  • Operations to improve the ranking of a third party site.
  • Using or inciting any form and by any means whatsoever, to one or more of the above described acts and activities.
  • And more generally any practice other than the Services for purposes other than those for which they were designed.
  • It is strictly forbidden for you to copy and / or divert for other purposes or those of third parties the concept, technology or any other element of the Site.
  • Any behavior likely to interrupt, suspend, slow or prevent the continuity of services.
  • Any intrusions or attempted intrusions into the Where Is My Mat systems.
  • All diversions to site system resources.
  • Any action likely to impose a disproportionate burden on the infrastructure of the Site.
  • Any infringement of security and authentication measures.
  • Any actions which could harm the rights and financial, commercial or moral value of Where Is My Mat or users of its site.
  • It is strictly forbidden to monetize, sell or license all or part of the Services or access to the site, and the information hosted therein and / or shared.
  • More generally; any breach of these terms.

10. Sanctions in case of violations

In case of a breach of any provision of these Terms or, more generally, violations of the laws and regulations by a User, Where Is My Mat reserves the right to take appropriate action including, but not limited to:
  • Suspending or terminating access to the Service for the Use
  • Removing any Content posted on the Site.
  • Publishing any message on the Site that we deem fit.
  • Inform any concerned authority.
  • Judicial action.

11. Liability and responsibility of Where Is My Mat

Where Is My Mat agrees to provide our Services with due diligence and in accordance with law and regulations.

Where Is My Mat has no knowledge of the Content posted by the Yoga Professionals within the use of the Service. We perform no moderation, selection, audit or control whatsoever and we act solely as a hosting provider. Consequently, we cannot be held responsible for Content, authored by third parties, and claims should be directed to the author of the Content in question. We should be informed about any Content which is harmful for any third party as stipulated by Article 6 6 I 5 of Act No. 2004-575 of 21 June 2004. If Content is in contradiction to our terms and conditions, Where Is My Mat reserves the right to take measures as set out in Section 11 of these Terms.

Where Is My Mat disclaims any liability for any loss of information accessible in the User's personal Profile; the latter must save a copy and cannot claim any compensation in this respect.

Where Is My Mat is committed to conducting regular checks to verify the functioning and accessibility of the site. As such, Where Is My Mat reserves the right to temporarily interrupt access to the Site for maintenance reasons. Similarly, Where Is My Mat cannot be held responsible for difficulties or impossibilities during temporary access to the Site that would have originated from circumstances that are external, force majeure, or due to disruptions in telecommunication networks.

Where Is My Mat does not guarantee Users:
  • That the Services, subject to constant research to improve such performance and progress, will be completely free of errors, defects or faults.
  • That the Services are standard and cannot be customized to one’s specific needs and expectations.

In any case, the liability for Where Is My Mat hereunder is expressly limited to direct damages suffered by the User, which need to be proven.

12. Intellectual property

Systems, software, structures, infrastructures, databases and content of any kind (text, images, video, music, logos, trademarks, database, etc.) operated by Where Is My Mat within the Site are protected by all intellectual property rights or rights of producers of existing databases. All disassembly, recompilation, decryption, excerpts, reuse, copies and, more generally, any act of reproduction, distribution and use of any of these elements, in whole or part without the permission of Where Is My Mat are strictly prohibited and may be subject to prosecution.

12.a Property Rights
All rights, economic and moral, intellectual property and/or industrial, related to Content and information elements of the website and present on the Site belong exclusively to Where Is My Mat, subject to any property right that may belong to a third party for which Where Is My Mat got the necessary approval of rights or permissions.

The rights granted to the User for the use of the Site and services provided by Where Is My Mat will outweigh any sale or other authorization to operate or use any of the materials on the Site.

12.b Protection of Trademarks, logos, links, info, etc.
All elements (brands, drawings, texts, hyperlinks, logos, images, videos, sound, software, layout, databases, codes, etc.) on the Site and associated sites are protected by national and international intellectual property laws. These elements remain the exclusive property of Where Is My Mat and/or its partners and/or users.

12.c Prohibition of unauthorized use.
You are not allowed to make any reproduction, republication, redistribution, adaptation, translation and/or partial or complete transformation, or transfer to another website any component and element present on the Site, without prior written permission of Where Is My Mat and/or its partners.

You agree not to submit, copy, sell, republish, or generally make available, in any form whatsoever, any information or material received from Where Is My Mat or available on the Site to another natural or legal person, of all countries.

You agree to comply with the above statements related to intellectual property provisions for Where Is My Mat.
12.d Sanctions
You recognize and acknowledge that non-compliance with these prohibitions constitutes as an act of infringement which is prosecutable by both civil and criminal law.

13. Personal data and privacy

We take your privacy very seriously. We have a separate Privacy Policy which you can find on our Site.

Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information (PII) in accordance with our Site and the applicable laws. Personal information is information that is personally identifiable, including your name, email, phone number, mailing address, etc.

14. Publicity

Where Is My Mat reserves the right to insert on any page of the Site and other communication to Users, any kind of advertising or promotional messages, in a form and under conditions that Where Is My Mat deems suitable.

15. Links and third-party sites

Where Is My Mat can in no case be held responsible for the technical availability of the website or mobile applications operated by third parties (including any partners) to which the user has access through the Site. Where Is My Mat has no liability for any content, advertising, products and/or services available on such websites and mobile applications operated by third parties (including any partner) which are governed by their own terms of use. Where Is My Mat is not liable for transactions between the User and any advertiser or merchant business (including any partners and Yoga Professionals) to which the User is guided to by our Site, and in no way will be a party to potential disputes, whether such third parties are concerned in the delivery of products and/or services, guarantees, statements and any other obligations to which such third parties are required.

16. Duration of Services and unsubscription

After subscribing to our Service, you are subscribed for an indefinite period. On request, we will deactivate your account, and remove your personal information from active service. After receiving this request, we will retain in our files and databases personal information to prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use and comply with legal requirements, for up to 18 months after the date of receipt of the deactivation request. Therefore, you should not expect that all of your personal information will be immediately and completely removed from our databases.

17. Entry into force

These general conditions came into force on 25 April 2016.
